Shibashi

Welcome to Shibashi. These Terms of Service ("Terms", "EULA", or "Agreement") govern your access to and use of the Shibashi mobile application and website (shibashiapp.com), operated by Lukasz Dmowski ("Developer", "we", "us", or "our").

By downloading, installing, or using Shibashi, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Service.

1. End User License Grant

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and execute one copy of Shibashi on an iOS device owned or controlled by you, solely for your personal, non-commercial educational use.

2. Shibashi Pro Subscriptions & Payments

• Subscription Billing: Shibashi offers optional premium features ("Shibashi Pro") via auto-renewable subscriptions (Monthly or Annual) or one-time lifetime purchases. Payments are billed directly to your Apple ID Account upon purchase confirmation.
• Automatic Renewal: Subscriptions automatically renew unless auto-renew is disabled at least 24 hours prior to the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• Free Trial Terms: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.
• Subscription Management & Cancellations: You can manage or cancel your subscription at any time by accessing your Apple ID Account Settings on your iOS device. Refunds are handled exclusively by Apple according to Apple Media Services Terms.

3. Intellectual Property Rights

All content within Shibashi — including but not limited to custom mnemonic stories, illustrations, visual card layouts, kanji breakdown algorithms, audio recordings, software code, branding, logos, and UI artwork — is the exclusive intellectual property of Lukasz Dmowski and Shibashi. All rights reserved.

4. User Restrictions

You expressly agree that you will not, under any circumstances:

• Copy, scrape, extract, crawl, reproduce, distribute, or create derivative works from any Shibashi content, flashcards, mnemonics, or audio files.
• Decompile, reverse-engineer, disassemble, or attempt to derive the source code or underlying database of Shibashi.
• Sell, resell, rent, lease, sublicense, or commercially exploit any part of Shibashi or its content.
• Bypass, disable, or tamper with any technical security protections or subscription validation mechanisms in Shibashi.

5. Service Availability & Modifications

We reserve the right to update, modify, suspend, or discontinue any feature or content within Shibashi at any time without prior notice. We do not guarantee uninterrupted or error-free operation of the Service.

6. Disclaimer of Warranties

SHIBASHI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF EDUCATIONAL CONTENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUKASZ DMOWSKI OR SHIBASHI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE SHIBASHI.

8. Termination

Your rights under these Terms will automatically terminate if you violate any restriction set forth herein. Upon termination, you must cease all use of Shibashi and delete all copies from your devices.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without giving effect to any principles of conflicts of law.

2. Scope of Protected Assets

Protection extends fully to all creative, functional, and digital elements of Shibashi, including:

• Visual Mnemonics & Artwork: All custom illustrated kanji flashcards, card layout designs, component iconography, and visual stories.
• Textual Content & Mnemonic Stories: All custom visual mnemonic descriptions, narrative etymologies, example sentences, and formatted breakdowns.
• Audio Recordings & Pronunciation Data: All audio files and custom audio playback mappings.
• Software & Database Structure: All underlying source code, web applications, database schemas (`cards.json`, `vocabulary_database.json`), and SRS algorithms.
• Branding & Trademarks: The name "Shibashi", the Shibashi App Icon, logo, slogan, and visual identity.

3. Prohibition of Unauthorized Reproduction & Scraping

Any copying, scraping, extraction, mirroring, redistribution, republication, or commercial exploitation of Shibashi content is STRICTLY PROHIBITED.

You may not, directly or indirectly:

• Automate data scraping, web crawling, or database extraction to harvest flashcards, mnemonics, or vocabulary data.
• Package or re-sell Shibashi mnemonics or flashcards into Anki decks, Quizlet sets, PDFs, physical books, or rival mobile/web apps.
• Upload or mirror Shibashi proprietary artwork or stories to file-sharing platforms or public repositories.
• Use Shibashi content for training commercial Artificial Intelligence (AI) or Machine Learning (ML) models without prior written consent.

4. Copyright Enforcement & Legal Action

We actively monitor digital platforms, app stores, and online repositories for infringement. We reserve the right to issue formal DMCA Takedown Notices, initiate app store removal proceedings, and pursue civil legal remedies to the fullest extent of international copyright law against any entity violating these terms.
